摘 要：近年来，我国涉众型经济犯罪呈现集中爆发态势，极大影响了经济发展和社会稳定。由于我国对此类违法犯罪行为的法律界定较为粗疏，对涉众型经济犯罪的定义界定模糊，不仅使得认定泛化，也给相关违法犯罪行为人提供了规避法律处罚的漏洞。涉众型经济犯罪所涉及的资产处置问题，关乎涉案群众的切身利益，处置不当极易引发上访，造成维稳难，群众满意度低。在侦查办案过程中，应着重致力于将追赃挽损行为融合于打击全链条，从而有效遏制涉众型经济犯罪，维护健康的社会经济发展秩序。

Research on the maximization of asset income of stakeholder economic crime

Abstract： In recent years， the focus of the outbreak of economic crimes involving the public has greatly affected the economic development and social stability. Because the legal definition of this kind of illegal and criminal behavior in China is relatively rough， and the definition of stakeholder economic crime is vague， it not only makes the identification generalized， but also provides loopholes for relevant offenders to evade legal punishment. The asset disposal involved in the economic crime of stakeholder type is related to the vital interests of the people involved in the case. Improper disposal can easily lead to petition， which makes it difficult to maintain stability and low satisfaction of the people. In the process of investigating and handling cases， we should focus on integrating the behavior of recovering stolen goods and pulling losses into the whole chain of cracking down， so as to effectively curb the stakeholder type economic crimes and maintain a healthy order of social and economic development.

隨着经济社会的快速发展，经济领域内以非法吸收公众存款、集资诈骗、组织领导传销、诈骗、合同诈骗、非法经营等行为表征的涉众型经济犯罪呈现多发、高发态势，严重扰乱了市场经济秩序，直接损害了广大群众的切身利益，成为影响社会稳定的重要因素之一。笔者结合临沂市兰陵县公安机关侦办涉众型经济犯罪案件实例，分析公安机关在办案实践中，充分运用刑法规制手段，使用掩饰、隐瞒犯罪所得、犯罪所得收益犯罪追究，维护正常的刑事追赃挽损工作，加大对财产权的执法保护力度，在涉案资产收益最大化方面做了有益的尝试，为有效缓解涉众型经济犯罪资产处置问题，尤其是涉众型经济犯罪追赃挽损工作不力，致使在资产处置陷入困境等方面的问题提供借鉴，为构建具有中国特色的金融犯罪预警防控体系而努力[1]。……
