【摘要】 本文以广东省打印耗材企业海外知识产权贸易壁垒纠纷案件为基础，通过分析打印耗材企业海外知识产权壁垒纠纷特征，从三个不同角度提出建议，以期加强打印耗材产业海外知识产权应对能力建设。

Research and Suggestions on Trade Barriers of Overseas Intellectual Property Rights in Printing Consumables Industry

Abstract： This paper analyzes the characteristics of overseas intellectual property barrier dispute of printing consumables enterprises，and puts forward suggestions from three different perspectives，in order to strengthen the construction of overseas intellectual property response ability of printing consumables industry.

1 引言

在经济全球化和知识经济背景下，中国凭借着劳动力资源优势，迅速发展成为全球打印耗材产品制造大国。但随着中国企业深度参与全球市场竞争，以欧美日为代表的发达国家及其跨国公司为维护既得利益，开始借助各种知识产权贸易壁垒打压和围堵我国企业，导致我国企业的海外生存环境不断恶化。

2 打印耗材行业海外知识产权贸易壁垒纠纷情况

截至2020年底，广东省打印耗材行业海外知识产权贸易壁垒纠纷案件共29起，其中，美国USITC337调查和起诉到美国法院的司法诉讼案件各14起，起诉到日本法院的诉讼案件1起。案件均为专利侵权，涉案产品包括墨盒及其组件、碳粉盒及其组件等。以上案件主要表现出如下特点。

1）案件在2010年达到峰值后趋于减少

2006年2月17日，爱普生公司向USITC提交调查申请并在俄勒冈州地区法院提起诉讼，指控24家公司向美国进口或在美国销售的墨盒，侵犯其在美国的11项发明专利权，由此揭开了广东省打印耗材企业海外知识产权纠纷案件的序幕。2010年案件最多，共发生9起，之后逐渐减少（图1）。
