摘要：档案利用权利是社会组织或个人在法律框架范围内合理利用档案馆保存的档案信息和档案内容的权利，其实现以国家综合档案馆认真履行档案服务职责为前提，以社会组织或个人积极行使档案利用权利为关键。从制度构建和制度运行的角度来看，通过改进档案收集制度、落实档案开放鉴定制度、优化档案利用服务制度、规范档案监督检查制度和完善档案利用权利救济制度，能够为档案利用权利实现提供一定的制度约束和机制支撑，彰显新《档案法》“权利义务相协调”和“以人为本”的立法理念。

Abstract：The right of archives utilization is the social organizations or individuals to make rational use of the archives information and archives con？ tent preserved by archives within the legal frame？ work. Its realization is based on the premise that the National Comprehensive Archives conscien？ tiously fulfill the responsibilities of archives service， and the key is that social organizations or individu？ als actively exercise the right of archives utilization. From the perspective of system construction and system operation， improving the archives collec？ tion system， implementing the open appraisal sys？ tem， optimizing the utilization service system， stan？ dardizing the supervision and inspection system， and improving the right relief system can provide certain institutional constraints and mechanism support for the realization of archives utilization rights， and highlight the concept of coordination of rights and obligations and people-oriented in the new archives law.

隨着时代发展，档案信息资源蕴含的经济和社会价值逐步彰显，其外部表现就是社会对档案的利用需求不断增长，对国家综合档案馆履行档案利用权利保障职责形成了倒逼态势。这使得探索档案利用权利的实现路径，调整社会在档案事务中的权利义务关系，成为档案部门需要破解的一道难题。[1]在此背景下，关于档案利用权利的研究日益引起学界的关注，例如，谭彩敏[2]从公民档案利用权发展历程的角度论述了公民档案利用权保障的必要性；罗军[3]从自由性、公平性和效益性三个维度分析了公民利用档案权利实现的主要内容等，为档案利用权利研究提供了参考。需要指出的是，在档案利用权利实现的过程中，必然面对档案开放与档案保密的博弈，以及传统服务理念和管理方式的阻力，这就需要运用制度加以规范和协调。……
