【摘  要】公路是现代经济社会最主要的公共基础设施，也是社会发展的重要产业经济支撑。随着我国经济发展进入新常态，公路发展不断呈现出其基础性、先导性和服务性产业的新特点，公路产业发展方式正在经历由传统自然垄断型向现代参与合作型过渡的历史过程。如何明确公路产业政府规制目标，完善公路产业政府规制主体的组织建制，对于建构法治化、现代化的公路产业政府规制体系，提高产业经济效能和社会效能具有重要的理论意义和现实意义。

【Abstract】Highway is the most important public infrastructure in modern economic society， and it is also an important industrial economic support for social development. With China's economic development entering a new normal， the development of highway industry is constantly showing new characteristics of its basic， leading and service industries. The development mode of highway industry is experiencing a historical process of transition from traditional natural monopoly to modern participation and cooperation. It is of great theoretical and practical significance to clarify the goal of government regulation of highway industry and improve the organizational system of government regulation subject of highway industry for the construction of a legal and modern government regulation system of highway industry and the improvement of economic and social efficiency of the industry.

1 公路产业政府规制主体现状概述

公路产业政府规制主体是一个在行政法学层次上被抽象和归纳的概念，在现实中则表现为一系列不同层级和不同属性的、履行公路产业政府规制职能、做出公路产业政府规制行为的政府规制机构①的集合。鉴于公路产业是涵盖公路设计与规划等前期决策、建设、养护、运输、经营、服务、行业管理、安全与应急保障等诸多内容于一体的综合产业部门，决定了公路产业政府规制机构的复杂性和多样性。

1.1 现行组织模式

现阶段，全国各省公路产业政府规制体系的主要模式是实行“条块结合、以块为主”的组织模式。省、市、县各级政府交通运输主管部门作为本级政府的工作部门，受本级政府统一领导并对其负责，同时受上一级交通主管部门的行业领导，主管本省行政区域内公路产业发展战略和规划、建设、养护、运营、管理等工作;各级交通运输主管部门之下又设立若干不同性质的公路产业规制机构，更加具体地履行公路产业政府规制职能。……
