摘 要：随着网络平台的兴起，观看Vlog短视频成为人们喜爱的文娱方式之一，大量的互联网自媒体人成为Vlog博主。然而，Vlog抄袭侵权问题屡见不鲜，成为发展中亟待解决的问题。因此，为确保自媒体行业的良性发展，本文针对自媒体著作权侵权抄袭行为，分析Vlog抄袭频繁发生的原因，从立法部门、网络平台、Vlog用户等方面提出相应的对策，将自媒体著作权保护纳入法治的轨道。

Research on the Problem of Vlog Plagiarism and Infringement of Copyright

Abstract： With the rise of online platforms， watching Vlog short videos has become one of people's favorite entertainment methods， and a large number of Internet self-media people have become Vlog bloggers. However， the problem of Vlog plagiarism and infringement is not uncommon， and it has become an urgent problem in development. Therefore， in order to ensure the healthy development of the self-media industry， this paper analyzed the frequent occurrence of Vlog plagiarism against the copyright infringement and plagiarism of self-media， and proposed corresponding countermeasures from the legislative department， network platforms， Vlog users， etc.， to bring the protection of self-media copyrights into the track of the rule of law.

随着自媒体平台的兴起，网络平台逐渐代替传统的传播媒介，成为经济、文化发展的重要载体，Vlog也伴随着网络自媒体平台的发展逐渐兴盛起来，然而，自媒体迅速发展的同时也带来了许多问题，例如，Vlog抄袭侵权事件频频发生[1]。本文着重探讨Vlog抄袭侵犯著作权的问题，分析Vlog抄袭频繁发生的原因，对Vlog抄袭侵权行为进行界定，针对Vlog抄袭侵权问题提出相关对策，更好地实现网络知识产权的规制与自媒体平台的发展。

1 Vlog简介及发展现状

近年來，互联网产业快速发展，大众的娱乐方式和载体变得复杂多样，视频博客（Video Blog，Vlog）是在早期博客（Blog）的基础上发展而来的，它是以动态化的录像替代传统的静态图片和文字的一种新兴表达方式[2]。Vlog是在2012年出现的一种新视频理念，其最先来自YouTube自媒体平台，它以第一人称为视角，运用拍摄、拼接、剪辑等方式来记录个体的日常生活，并在自媒体平台上实时共享，展现了创作者的个性风格、人生价值、生活态度与思想理念。……
