摘 要：我国外观设计专利申请、授权量连创新高，但存在“多而不优”的难题。知识产权保护中心专利快速审查服务将部分专利审查工作前置，在申请人正式向国家知识产权局提交申请之前，及时发现申请文本中存在的问题并告知申请人改正，以提升专利质量和授权率。本文基于专利预审员实际工作经验和思考，指出了外观设计专利创造、申请、预审工作中存在的问题，并针对问题提出解决方案，以期提升外观设计专利质量，为专利质量提升工程献智献力。

Research on the Improvement of Design Patent Quality Based on the Perspective of Patent Pre-examiner

Abstract： The number of design patent applications and authorizations in China has hit record highs， but there is a problem of "although many but not good". The rapid patent examination service of the Intellectual Property Protection Center will advance part of the patent examination work， and promptly discover the problems in the application text and informs the applicant to make corrections before the applicant formally submits an application to the State Intellectual Property Office，， in order to improve the patent quality and authorization rate. Based on the actual work experience and thinking of patent pre-examiners， this paper pointed out the problems in the creation， application， and pre-examination of design patents， and proposed solutions to the problems， with a view to improving the quality of design patents and contributing intellectual contributions to the patent quality improvement project.

2017年以来，国家知识产权局陆续在各优势产业集聚区布局建设知识产权保护中心（以下简称保护中心），建立案件快速受理和科学分流机制，提供快速审查、快速确权、快速维权“一站式”纠纷解决方案。截至目前，已经批复或建成的知识产权保护中心有浦东、烟台、深圳、南京、常州、长沙、佛山和东营等。

保护中心主要负责专利快速审查、快速确权工作、知识产权维权援助、专利导航与知识产权运营等工作。快速审查为专利提交国家知识产权局之前的预审服务，将专利的形式和新颖性问题审查前置，以提升专利授权速度与质量。专利快速审查工作机制如下：各企事业单位到注册地（营业执照注册地）所属的保护中心备案，备案成功的主体将撰写好的专利递交到……
