摘 要：共享汽车是共享经济的重要组成部分，共享汽车行业有交易风险可控性和交易方便的属性。共享汽车行业便利了人民群众的日常出行，同时给当地带来大量就业机会，促进当地经济社会发展。然而，共享汽车行业也有自身的风险，第一是对传统出租车行业的冲击给当地带来不稳定社会因素，第二是是共享汽车行业门槛较低，行业内有可能发生违法犯罪的情形，第三是存在着泄露用户隐私的风险，第四是可能带来交通安全隐患。针对以上风险，治理对策是：在立法层面，有针对性地进行地方立法;在执法方面，对行业进行严格监管;在守法层面，应当促进行业自律，促使网络平台履行自身法律义务。

Legal Countermeasures for the Healthy Development of Shared Car Industry

Abstract：Car sharing is an important part of the sharing economy. The sharing automobile industry has the attributes of controllable transaction risk and convenient transaction. The car sharing industry facilitates the daily travel of the people， and at the same time brings a lot of employment opportunities to the local people， and promotes the local economic and social development. However， the car sharing industry also has its own risks. The first is that the impact on the traditional taxi industry brings unstable social factors to the local area; the second is that the threshold of the sharing automobile industry is low， and there may be crimes in the industry; the third is the risk of disclosing users' privacy; the fourth is that it may bring traffic safety risks. In view of the above risks， the countermeasures are： at the legislative level， targeted local legislation; in law enforcement， the industry should be strictly supervised; at the law-abiding level， self-discipline of the industry should be promoted and the network platform should fulfill its legal obligations.

隨着“互联网+”时代的到来，共享经济颠覆和重构了传统的经济发展模式，共享公寓、共享单车、共享充电宝等新事物应运而生，在交通领域，除了共享单车之外，共享汽车行业开始逐渐引起人们的重视，但是也随之而来了一些负面的问题。在法治社会中，法律是社会治理的重要工具，也是促进和保障经济发展的重要手段，因此，面对共享汽车行业发展的诸多困境和风险，我们有必要运用法律的思维，提出有价值的法律对策。
