摘 要：区块链的应用场景覆盖知识产权管理、应用与法律保护等多个领域。在“区块链+知识产权”实践应用中，衍生了数据治理风险高企、技术支撑度不足、法治保障乏力等困境，对此，可以采取健全“区块链+知识产权”法治治理框架、制定“区块链+知识产权”技术安全标准规范、提升“区块链+知识产权”应用技术功能、优化“区块链+知识产权”融资与司法适用机制等措施，完善“区块链+知识产权”应用生态，化解“区块链+知识产权”应用之技术风险、场景优化与法律滞后之间的矛盾与冲突。

Abstract： The application scenarios of blockchain cover multiple fields such as intellectual property management， application and legal protection. The practical application of "blockchain + intellectual property" has resulted in difficulties such as high data governance risks， insufficient technical support and weak legal protection. For this situation， Measures such as improving "blockchain + intellectual property rights" legal governance framework， formulating "blockchain + intellectual property" technical safety standards and regulations， developing "block chain + intellectual property" application technology functions and optimizing "block chain + intellectual property" financing and judicial application mechanisms are adopted to improve the application ecology of "blockchain + intellectual property" and resolve the contradictions and conflicts between "blockchain + intellectual property" application technology risks， scenario optimization and legal lag.

區块链作为一种新兴的应用模式，在金融服务、供应链管理、文化娱乐、智能制造、社会公益和教育就业等领域有着广泛的应用价值。2021年6月7日，工业和信息化部、中央网信办印发《关于加快推动区块链技术应用和产业发展的指导意见》，提出在产品溯源、数据流通、供应链管理等领域形成区块链①场景化的示范应用。区块链作为一种去中心化的基础架构与分布式计算账本，其应用场景覆盖政府治理、金融科技、知识管理、证券融资与司法存证等多个领域。其与知识产权管理、运用与法律保护之间具有内在的关联与契合性。区块链的去中心化、不可篡改、分布式容错、匿名保护等技术优势，以及共识机制、智能合约、加密算法与松耦合数据结构设计等核心技术，可以为知识产权链上确权、知识产权溯源审计、知识产权交易、知识产权侵权监测与固证等，提供技术支撑。……
