【摘 要】随着我国城市化进程与公共设施建设步伐的加快，农村土地征收日益成为土地管理中至关重要的一个问题。一方面，包含农用地、宅基地和建设用地的农村土地，作为最基本的生产资料，是农民的立身之本，更是社会和谐稳定的基础;另一方面城市化不断发展的进程造成农村土地利益分配的冲突。那么，如何应对农村土地征收中的补偿问题呢？笔者认为，进一步完善法律法规制度，是基本的解决对策。

【Abstract】With the speeding up of the process of urbanization and the construction of public facilities， the rural land expropriation is becoming an important problem in land management. On the one hand， rural land， which includes agricultural land， housing plot and construction land， is the most basic means of production， which is the foundation of farmers' social stability and stability; on the other hand， the continuous development of urbanization causes rural land Conflicts of Interest Distribution. So， how to deal with rural land expropriation in the compensation problem？ The author believes that further improve the laws and regulations， is the basic solution.

1. 農村土地征收的立法现状

土地征收是指国家为了公共利益需要，依照法律规定的程序和权限将农民集体所有的土地转化为国有土地，并依法给予被征地的农村集体经济组织和被征地农民合理补偿和妥善安置的法律行为。我国征收集体土地的所依据的法律法规目前，是在国家根本大法《宪法》的指导下，以《中华人民共和国土地管理法》等为主，同时根据各省、市级人民政府制定的一些法律规章、地方法规。

2. 农村土地征收存在的问题

2.1 公共利益界定不清，土地征收滥用严重。

我国《宪法》第10条规定：“国家为了公共利益的需要，可以依照法律规定对土地实行征收或者征用并给予补偿”。然而何为公共利益？我国相关法律并没有作出规定，这无疑扩大了政府的自由裁量权，易造成滥用土地征收权力的现象。

2.2 补偿收益主体不明确，补偿分配不合理。

首先，我国的《宪法》、《物权法》、《土地……
