【摘 要】科学技术日新月异的进步，使得各个国家以先进生产力作为主要竞争手段。创新与发明就是其中不可缺少的助力，然而当前我国对于专利保护尚不完善，国民对于专利概念仍处于摸索阶段。论文主要研究了关于知识产权中专利保护策略的四个阶段性的保护策略，并提出了相关几点建议，以提升对专利保护的重视。

【Abstract】 The development of science and technology changes with each passing day， which makes every country take advanced productivity as the main competitive means. Innovation and inventions are indispensable assists ，however，at present， the patent protection in China is not perfect， and peoples concept of patent is still in the stage of exploration. The paper mainly studies the four stages of protection strategies of patent protection in intellectual property rights， and puts forward some relevant suggestions， so as to enhance the importance of patent protection.

1 引言

社会经济体系全球化，对于科技创新、科技发展、科技进步的需求越为广泛。一个国家的创新水平与国家的发展与进步密不可分，保护发明创造者的知识劳动成果也就成为保障国家科技创新的条件。在知识产权中的保护中，专利保护是重中之重，专利保护既能保护人类智慧的劳动成果，又能体现一定的公平性。国家提供的专利保护，激励了人们对于科学探索的热情，是一种有效的激励手段和机制。

2 专利保护的概述

2.1 专利保护的由来

中世纪西方国家为了促进国家经济发展，一些国家君主为了打破技术封锁局面，引进先进科学技术，给予引进人制造或贩卖某种技术或产品的特权。随着时代变迁，越来越多发明人寻求对自身创造成果的法律保护，根据历史记载，世界上最先实行专利制度，并形成独立的法律条文的国家是威尼斯共和国。我国根据我国国情，制定了适合我国经济发展，并平衡各方面利益的专利保护制度，实行我国自己的《专利法》[1]。……
