【摘 要】“美丽中国”是中国共产党第十八次全国代表大会提出的概念。习近平总书记在全国生态环境保护大会上指出，“要通过加快构建生态文明体系，确保到2035年，生态环境质量实现根本好转，美丽中国目标基本实现。”“美丽中国”的建设需要法治保障，通过进一步健全环境保护的法制体系，确保“美丽中国”建设的顺利开展。

【Abstract】"Beautiful China" is the concept put forward in the 18th National Congress of the Communist Party of China. In the National Ecological Environment Protection Conference， the general secretary Xi Jinping pointed out that "through speeding up the construction of the ecological civilization system， we should ensure that by 2035， the quality of the ecological environment will be fundamentally improved and the goal of beautiful China will be basically realized." The construction of "beautiful china" needs the legal guarantee， we should further improve the legal system of environmental protection， so as to ensure the smooth development of "beautiful China" construction.

1 “美丽中国”的提出

中国是美丽的，这丝毫没有人怀疑，但随着中国步入工业化社会，人口的急剧增加，人与自然的矛盾也随之激化，中国的自然环境也随之污染严重。在这样的情形下，建设美好家园，改善生态环境也就提到了非常急迫的境地。2012年11月8日，中国共产党第十八次全国代表大会在北京召开。胡锦涛同志在十八大报告中明确指出：“建设生态文明，是关系人民福祉、关乎民族未来的长远大计。面对资源约束趋紧、环境污染严重、生态系统退化的严峻形势，必须树立尊重自然、顺应自然、保护自然的生态文明理念，把生态文明建设放在突出地位，融入经济建设、政治建设、文化建设、社会建设各方面和全过程，努力建设美丽中国，实现中华民族永续发展。”11月15日，新当选的中国共产党总书记习近平同志在常委见面会上的讲话中提到：“我们的人民热爱生活，期盼有更好的教育、更稳定的工作、更满意的收入、更可靠的社会保障、更高水平的医疗卫生服务、更舒适的居住条件、更优美的环境，期盼着孩子们能成长得更好、工作得更好、生活得更好。……
