[摘 要] 经济全球化不仅带来世界范围内经济上的合作与竞争，也促进了各国各民族的文化交流与融合，文化产业作为新的社会经济增长点，其安全性日益受到重视。尤其是在对外开放的背景下，如何保护国家文化产业安全不受侵害成为重要问题。本文通过分析文化产业的性质、对外开放对文化产业的影响和现有法律规范的方式，提出保护我国文化产业安全的合理建议。

Legal Consideration of National Cultural Industry Security

[Abstract] Economic globalization has not only brought worldwide cooperation and competition in economic area， but also promoted cultural communication and integration by each country and each nation. National cultural industry security has been given more attention as it becomes new economic growth.It becomes a significant issue that how to protect national cultural industry security from infringement， especially in the context of opening-up. This paper is conducted to put forward some reasonable proposals to protect national cultural industry security by varieties of ways.

近年来，随着高新技术的不断发展及推广，知识经济正在成为影响全世界各个国家、地区之间竞争格局的重要力量，而文化产业正是知识经济时代的标志性产物。尽管“文化产业”这一概念的提出在国际上仅有半个世纪的历史，但经过一段时间的探索，文化产业从过去作为一个附属的产业形态，逐步发展成为能集中体现现代社会经济、文化发展的不可忽视的产业领域。作为21世纪新兴的“朝阳产业”之一[1]，文化产业已成为社会新的经济增长点，在全世界范围内堪称现代经济的重要支柱。随着国际范围内文化交流的日益频繁及深入，我国文化产业国际竞争力提升的同时，也面临更多的挑战与危机，因此我国在发展文化产业的同时必须加强对文化产业安全的保护。
