[摘 要] 版权制度的产生、发展与技术变革具有密切关联，技术变革既推动了版权制度的发展与完善，也给其带来严峻挑战。云计算技术下作品传播利用的新特点使版权制度陷入困境。作为一种路径选择，替代版权模式难以落地生根，版权制度的未来方向应在现有法律框架内，通过调整版权专有权利、合理界定公有领域、引入反垄断条款，实现版权制度的平滑过渡，当然，替代版权模式可减少法律运行成本，促进未来版权制度的优化。

On the Dilemma and Future Development of Copyright

[Abstract] The generation and development of copyright system are closely related to technological change. Technological change has not only promoted the development and improvement of the copyright system， but also brought the serious challenge.The new characteristics of propagation and using made the copyright system in trouble under cloud computing technology.As a choice，to give up the current copyright mode is impossible.The future direction of the copyright system should be within the existing legal framework，by adjusting the copyright proprietary rights，reasonable definition of the public domain，introducing of antitrust terms，which can realize the smooth transition of the copyright. of course，the alternative copyright can reduce legal running cost and promote the copyright system optimization in the future.

本地计算下，信息的计算与处理主要依赖本地计算机硬件与软件资源，因此，基于用户软件、硬件系统信息存储容积的制约，加之，用户还需负责软硬件系统的维护更新等，致使本地计算成本高昂、效率低下。随着分布式运算、多租户架构技术的发展，带宽及流量的大幅提升，软件应用和数据存储均可在云端进行，用户可以随时、随地、按需向云端资源池发布指令调取所需资源，云端资源池根据用户指令快速配置和释放资源，云计算便是这样的一个计算过程。截至目前，国际间对于云计算究竟要如何具体定义尚未取得共识[1]。但对于云计算的技术特征业界有统一认识，云计算具有软件即服务（SaaS）、平台即服务（PaaS）、基础设施即服务（IaaS）三种服务模式，具有私有云、公有云、社区云与混合云四种部署模式，具有按需自助服务、广泛的网络访问、资源池、快速灵活、计量付费服务五个基本特征。……
