摘要：国际工程相对于一般项目要比较复杂，因为其受地理自然环境限制，工程技术复杂程度较高，整体性强，工程建设周期长，大部分的承包商都会采用“中标靠低价，盈利考索赔”的想法，因此，作为我们业主不仅要有预防索赔的意识，还要掌握如何控制不可避免的索赔，是投资更合理优化。

Abstract: the international engineering than the general the project to be more complex, because the natural environment by geographical restrictions, engineering technology complex degree is higher, integral sex is strong, engineering construction cycle is long, most of the contractor will use "on the lower prices and profit exam claim" idea, therefore, as we should have not only prevent claim the owner of consciousness, and grasp how to control the inevitable claim, is more reasonable investment optimization.

1工程索赔的概念

建设工程索赔通常是指在工程合同履行过程中，合同当事人一方因对方不履行或未能正确履行合同或者由于其他非自身因素而受到经济损失或权利损害，通过合同规定的程序向对方提出经济或时间补偿要求的行为。

2 工程索赔的起因

国际工程大多是工期长规模大结构复杂的工程项目。在工程项目的进行中由于自然条件或社会条件的变化，必然会为承包商的索赔提供许多机会。因此，作为业主方要想很好的预防和控制这些索赔，就必须清楚地认识和了解索赔，以便更好地掌握和应用于实际工程中。

2.1 合同不够严谨

对于工程来说实质上是合同当事人双方的一种“买卖”消费行为，业主方作为买方，往往会由于自信和社会现象的偏袒而忽略细小的环节，如对相关法律条款、索赔意识的淡化以及对工程承包方的信任而疏忽的认为合同条款可在今后施工过程中边施工边完善，造成工程实施过程中合同双方的不知所措。……
