摘 要：随着互联网的普及和发展，同人作品突破了圈子的限制，向外广泛传播，受众群体也逐渐扩大，随之而来的是同人作品创作者和互联网平台、网络出版商之间产生了一系列的矛盾，主要体现在同人作品的创作和利用与原著创作者之间的利益冲突。在这些矛盾不断加深的情况下，现行的《中华人民共和国著作权法》由于对同人作品没有明确的规定，无法平衡同人作品创作者与原著创作者各自的利益诉求，尤其是无法妥善地保护同人作品创作者的创作劳动。因此，有必要对同人作品的性质进行更充分的研究，通过适当的途径，在维护原著创作者合法权益的同时能兼顾同人作品创作者的利益，激发后来者进行二次创作的积极性。

Abstract： With the popularity and development of the Internet， fan works have broken through the restrictions of the circle， spread widely， and the audience group has gradually expanded， what followed is a series of conflicts between the creators of fan works and Internet platforms and online publishers， which are mainly reflected in the conflict of interest between the creation and use of fan works and the creators of the original works. As these contradictions continue to deepen， because there are no clear regulations on fan works， the current "Copyright Law of the People's Republic of China" cannot balance the interests of creators of fan works and creators of original works， in particular， the creative labor of creators of fan works cannot be properly protected. Therefore， it is necessary to conduct a more thorough research on the nature of fan works， through appropriate channels， while maintaining the legitimate rights and interests of the creators of the original works， the interests of the creators of the fan works can be taken into consideration， and the enthusiasm of the latecomers for the second creation can be stimulated.

同人作品是一種小众作品，这个概念是从日本传到我国的，以日语中的“同人誌”一词作为这种作品的称谓，在我国又被称为同人志。有着相同兴趣爱好的读者和创作者自发组成了一个规模较小的群体，他们进行创作后将作品在特定的范围内分享和传播，这种行为一般是非营利性的，基本不在收费平台发布，受商业因素影响较小[1]。就同人一词来讲，原本的含义是同志，这强调了同人圈的行为更具有自发性，而不是逐利性。同人作品创作者具有高度的自由性，不必为了市场的反馈而刻意迎合读者的口味，这也保证了同人作品的内容更具有广度，更能体现创作者的心意，也在一定程度上具有质量保证。……
