摘 要:关于汽车机件损坏与交通肇事之间的因果关系鉴定,往往涉及交通事故力学、材料力学、断口金相分析、汽车结构以及法医学等多学科综合知识,需要司法鉴定人充分掌握并运用,才能作出科学、客观、专业的鉴定意见。文中将通过一起案例解析,对此类事故的司法鉴定基本原则、鉴定要素、核心技术、计算方法等鉴定技术方法作一些说明及探讨。

Appraisal Method of Causal Relationship between Damage of Automobile Parts and Traffic Accidents

Abstract:The identification of the causal relationship between automobile damage and traffic accidents often involves comprehensive knowledge of traffic accident mechanics, material mechanics, fracture metallographic analysis, automobile structure, and forensic science. Forensic experts need to fully grasp and apply them, to make scientific, objective and professional appraisal opinions. In this article, through a case analysis, some explanations and discussions will be made on the basic principles, identification elements, core technologies, calculation methods and other identification techniques of such accidents.

1 案例
1.1 案情簡介
D某驾驶小型轿车(以下简称轿车)在某公路上行驶至某村直线路段,失控向右前方冲出道路后,碰撞路边绿化树,造成一死二伤、车辆受损的道路交通事故。
1.2 事故现场情况
事故路段为国道线某村庄路段,以事故轿车行驶方向,右转弯道下坡进入直行路段,水泥路面,路面平整干燥,晴天。事故现场直行路段呈南北走向,双向各一条机动车道与非机动车道,机动车道宽4米,非机动车道宽2米,西侧路边缘与路外高差为0.17米。轿车头西南尾东北停止于道路西侧,左前、后车轮中心距道路中心分道线分别5.62米、3.64米。
1.3 轿车车体损坏情况
轿车车身前部距右边缘约70cm范围见碰撞挤压向后变形,右侧最大变形深度约为85cm,前横梁右侧弯折变形,左侧与纵梁焊接处断裂,发动机罩右前部由前向后呈弯折弓起,散热器右侧损坏并向后移位,右前照灯组破碎,右前翼子板弯折外凸、脱落,右A柱断裂,右前车门框变形,右前轮轮胎碰……
