摘 要：当前，黑恶势力组织犯罪呈现一种新的形态，即由初期明显暴力手段，转变为软暴力威慑，在一定区域或行业内，形成非法控制和重大影响，严重破坏了经济社会秩序。深入剖析黑恶势力组织犯罪中的软暴力现象，有助于准确打击黑恶势力犯罪，提升公众的安全感，促进社会和谐稳定。

On the strategies of public security organs to crack down on Soft Violence Crimes

Abstract： At present， the organized crime of the underworld and evil forces presents a new form， that is， from the early obvious means of violence to soft violence deterrence， which forms illegal control and significant influence in a certain region or industry， and seriously damages the economic and social order. In depth analysis of the phenomenon of soft violence in the crimes organized by the underworld and evil forces will help to accurately crack down on the crimes committed by the underworld and evil forces， enhance the publics sense of security， and promote social harmony and stability.

软暴力是近年来刑事司法实践中多次出现并被使用的高频词汇。2019年4月9日，最高人民法院、最高人民检察院、公安部、司法部在总结司法实践的基础上，联合颁布了《关于办理实施“软暴力”的刑事案件若干问题的意见》（以下简称《意见》），进一步对黑恶势力违法犯罪的软暴力手段作出界定和细化，解决了司法机关认定黑恶势力违法犯罪软暴力手段的法理依据。鉴于软暴力长期以来游走于法律边缘，为依法、准确、有力惩处，有必要对黑恶势力背后的软暴力涵义、特征、打击难点和策略等问题加以研究，以期能为公安机关执法办案实践提供些许参考和借鉴。

一、软暴力概述

从规范意义的角度上，目前理论界尚未达成一致的共识，也难以形成精确的定义。就其实质而言，软暴力是暴力、威胁手段之外能够对他人形成心理强制或足以影响、限制人身自由、危及人身财产安全或者影响正常生产、工作、生活的手段，其是与传统通过有形物理力所实施的暴力相对应的暴力形式。就内涵而言，软暴力是黑恶势力……
