摘要：随着中国的发展向知识经济转型，知识产权保护愈发受到国家重视，而知识产权战略也被列为国家基础战略之一。以权利人在维权过程中所面临的实际困难为基础，以如何破除三种不同知识产权保护方式之间的壁垒为切入点，针对机构改革后知识产权保护中存在的痛点、堵点问题，从制度建立、职能衔接、流程设计三个维度进行深入思考，探索以保护中心为纽带，构建知识产权系统保护能力的道路。

Constructing the System Protection Ability of Intellectual Property with Protection Center as the Link

Abstract： With the transformation of China’s development to a knowledge-based economy， intellectual property pro？ tection is increasingly valued by the state. China makes intellectual property strategy one of the country’s basic strate？ gies. This article is based on the actual difficulties faced by rights holders in the process of rights protection， and how to break down the barriers between the three different intellectual property protection methods as the starting point. In view of the pain points and blocking points in intellectual property protection after the institutional reform， indepth thinking is carried out from the three dimensions of system establishment， function connection and process de？ sign to explore the way to build the protection capability of the intellectual property system with the protection center as the link.

隨着中国向信息社会和知识经济方向发展，知识产权保护与经济、科技、文化等领域的发展联系日益紧密。2019年11月，中国共产党中央委员会办公厅、中华人民共和国国务院办公厅联合印发《关于强化知识产权保护的意见》（以下简称《意见》）。《意见》提出知识产权“严保护、大保护、快保护、同保护”的工作要求。这既是党中央对知识产权事业的顶层设计，也是领导层对知识产权工作的殷切期望。

2018年，我国进行了机构改革，按照国家机构改革部署，组建国家市场监督管理总局，同时重组国家知识产权局。国家知识产权局将原商标局及质检总局部分职能进行整合，实现专利、商标、原产地地理标志的集中统一管理，将原专利执法、商标执法工作统一纳入市场监管综合执法[1]。在改革的大环境下，知识产权保护中心也应运而生（以下简称保护中心）。……
