【摘 要】近年来，随着计算机网络技术的发展，网络游戏成为人们缓解压力的重要方式。与此同时，网络虚拟财产受到人们的重视。在当前法制环境下，物权法对于网络虚拟财产具有一定的适用性。基于此，论文在研究中通过对首例虚拟网络财产纠纷案的分析，首先，对网络虚拟财产与物权法加以概括。其次，阐述首例网络虚拟财产纠纷案，并探讨《民法总则》的立法导向。最后，重点研究网络虚拟财产中物权法请求权具有的适用性。

【Abstract】 In recent years， with the development of computer network technology， online games have become an important way to relieve stress for people. At the same time， people pay more attention to the network virtual property. Under the current legal system， the Property Law has certain applicability to the network virtual property. Based on this， through the analysis of the first case of virtual network property disputes， this paper firstly summarizes the network virtual property and the Property Law. Secondly， it expounds the first case of network virtual property dispute and discusses the legislative direction of the "General Provisions of Civil Law". Finally， it mainly researches the applicability of the claim of property law in virtual property.

1 引言

自改革开放深入实施，我国法制体系逐渐完善。伴随着生活水平的提升，人们逐渐加强对私有财产的重视，包括私有的网络虚拟财产。通俗来讲，网络虚拟财产属于新兴的财产形态，在信息化时代下受到了人们的普遍认可。但是，学术领域中对于网络虚拟财产的法律属性归属，仍存在较大的争论，且尚未有系统的论证。关于网络虚拟财产的法律属性争论，主要以物权说、知识产权说、债权说和财产说为主。因此，本文从首例网络虚拟财产纠纷案角度分析物权法对网络虚拟财产的保护。

2 网络虚拟财产与物权法概括

2.1 网络虚拟财产

近年来，随着互联网信息技术的普及，网络虚拟财产不断增多，且受到人们的普遍关注。实际上，网络虚拟财产是随着网络技术的发展，而不断兴起的[1]。因此，其也被称之为虚拟财产，是虚拟网络空间中财产的具体表现形态，能够被人为地支配，且具有一定的价值权利。……
