摘 要：随着我国监察制度改革不断推进，国家监察委员会将逐步替代检察机关成为高规格、全覆盖、一体化的反腐败中坚力量。检察机关在国家法治体系中的地位和职能将面临重大调整，增强公益诉讼制度中检察机关的作用是改革的主流方向。如何正确认识当前公益诉讼中检察机关的重要作用，如何运用域外法治发达国家检察机关角色定位的有益经验，如何在检察机关承担公益诉讼职能的司法试验工作中及时发现不足、总结经验，如何正确定位我国未来公益诉讼制度中的检察机关，将是制度设计和调整必须攻克的核心难题。

Abstract：With the reform of supervision system of our country keeping the pace， the National Commission will gradually replace the procuratorial organs， becoming anti-corruption backbone of high specifications， full coverage， and integration. The function and position of the procuratorial organ in the national legal system will face a major adjustment，with enhancing the public interest litigation system in procuratorial organs the mainstream direction of reform： how to correctly understand the important role of the procuratorial organs in the public interest litigation，； how to utilize the good experience of procuratorial organs role of foreign developed countries； how to timely find out problems and get experienced when the procuratorial organ bearing the judicial trial work of public interest prosecution； and how to correctly position the procuratorial organ of our country in the public interest litigation system in the future； these are the core difficulties in need of solutions for the design and adjustment of system.

2015年7月，根據党的十八届四中全会相关决议，最高人民检察院向选定的13个试点区域①

人民检察院印发《检察机关提起公益诉讼试点方案》，标志着建立健全我国公益诉讼制度的司法试验工作步入实践阶段，旨在形成立体化社会公益保护体系，强化检察机关法律监督职能。贵州省作为13个改革试点区域之一，结合本省工作实际，在试点司法工作期间，着重对生态环境和资源保护领域的案件进行了公益诉讼尝试。本文拟运用近两年试点司法工作过程中的大量真实案件为样本，分析检察机关提起公益诉讼工作当前的实际情况，结合域外有益经验，对检察机关在我国未来公益诉讼制度中正确的角色担当提供理论参考。……
