摘要：

贵州大数据“聚、通、用”面临数据聚集速度较低、共享交换水平和数据应用质量不高的问题，主要原因是大数据的财产性质及其产权尚未明晰，大数据蕴含的法律问题始终是大数据发展中的“达摩克利斯之剑”，大数据运用的法律边界并未厘清。可以采取如下方式解决：准确厘定各义务机关在大数据“聚、通、用”中的利益分配，优化人力资源考核的指标体系，确定数据挖掘整理者的产权与责任，对大数据“聚、通、用”中的刑事责任追究持审慎姿态，对个人数据的挖掘与使用持慎重态度。

Abstract：

Big data in Guizhu faces problems of slow collection， low-quality sharing， exchange and application， of which the main cause is that the property nature and property rights of big data are undefined so that legal problems in big data plays as “the sword of Damocles” ， and the legal boundary of big data application remains unclear. The solutions are as follows： defining the exact allocation of interest shares for every responsible agencies， improving the evaluation system of human resources， making clear the property rights and responsibility for persons who find and sort out big data， keeping rigorous in criminal accountability and personal data finding and application.

在信息快速傳递的背景下，海量数据的聚集、各个信息点的联通、海量数据的使用，既是新时代必须解决的问题，也是世界走向未来的推动力，为此，各种关乎大数据“聚、通、用”的技术问题、社会管理问题以及相应的法律问题应运而生。本文对大数据“聚、通、用”的法律困境及其出路进行讨论。

一、贵州省大数据“聚、通、用”存在的问题①

在“十三五规划”期间，贵州省确定了“大扶贫、大数据、大生态”三大战略行动，目前，大数据战略行动处于如火如荼的发展态势。大数据“聚、通、用”是贵州省大数据发展的核心和基础，充分挖掘大数据的商用、政用和民用价值是大数据发展的目标。近年来，在大数据“聚、通、用”的发展中出现了一些亟待解决的问题，主要表现为：

（一）数据聚集的速度不快

迁入的系统大多数是门户网站和小型应用系统，对于人口、法人、自然资源和空间地理、宏观经济四大基础数据库等不少数据量大、服务公众面广、实时数据更新快的应用系统尚未迁入平台。……
