医疗信息披露视角下医患纠纷成因与对策分析

本文运用信息不对称、委托代理、道德风险和逆向选择等信息披露理论工具分析医患纠纷产生的原因，包括：医患之间信息不对称，供给诱导需求现象严重；医患双方利益不一致；医患双方道德风险并存；逆向选择导致医疗服务质量下降等。结合医疗信息披露的现状探讨基于医患纠纷管理需求的医疗信息披露对策：落实信息披露责任；建设医患互评披露平台；披露违规行为，杜绝违规收益；引入竞争机制，完善信息披露；建构信息披露的导向性文化。

［Abstract］This paper uses information asymmetry，principal-agent，moral hazard and adverse selection and other theoretical tools to analyze the causes of disputes between doctors and patients：information asymmetry exists between doctors and patients，and the supply-induced demand is serious；the interests of both doctors and patients are not consistent；moral hazard exists between them；adverse selection led to a decline in the quality of medical services.And combined with the present situation of medical information disclosure，to discuss the countermeasures of medical information disclosure based on the demand of medical dispute management：to implement the responsibility of information disclosure；to build the platform of mutual evaluation of doctors and patients；to disclosure violations，prevent illegal gains；to introduce of competition mechanism，improve the information disclosure；and to construct information disclosure oriented culture.

近年来，医患纠纷的数量急剧增长，舆论导向片面化，医患冲突激烈化，患方诉求功利化，使得医患纠纷日益演化成社会性事件，备受人们关注。针对医患纠纷的研究，现有的文献主要从法律视角［1］、社会视角［2］及医院质量管理视角［3］等展开论述，然而医患纠纷的递增，除法律框架本身的原因外，很大程度上与医疗行业监管体系、医院治理密切相关。本文从医疗信息披露的视角来分析医患纠纷的发生原因，并结合信息披露的现状分析医患纠纷的防范措施，旨在通过更好地发挥医疗信息披露的作用，促进医患之间的信息公平，协调医患利益诉求，规避道德风险，防止出现逆向选择，进而有效防范和处理医患纠纷，保障医疗卫生服务的顺利开展。……
