摘 要：随着社会经济的不断发展，公务员违纪行为不仅数量在增加，同时也呈现出新的特点。规范公务员的行为，不仅需要领导层面的监督和社会层面的倡导，更应该完善的是我国公务员相关违纪行为的法律责任。想要减少或杜绝公务员违纪现象，不能依靠公务员个人素质的提高，而要依靠完善的制度设计来规制公务员的违纪行为。本文将从公务员违纪行为的种类、公务员违纪行为的法律责任等几个方面来阐述该问题，并为完善我国公务员违纪行为法律责任制度提出建议。

Abstract：In the continuous economic development in today's society ， civil misconduct uncommon in our country ， such as Shanxi Shenmu Justice sued the mine beg for ten million yuan bonus ， Zhang Yang civil service recruitment case ， the Chongqing Justice Bureau Wen Qiang sacked case and so on.So， in today 's increasingly advocated Against social reality ， why still so endless civil misconduct it ？ I think that regulate the conduct of civil servants ， not only need to monitor the level of advocacy and social leadership level ， but should improve the legal responsibility of the civil service -related disciplinary offense . Want to reduce or eliminate the violations are civil servants ， civil servants can not rely on improved personal qualities ， but to rely on a sound system designed to regulate the civil service disciplinary offense.

1 我國公务员违纪行为的种类

公务员纪律是指以法律方式规定的被用来指导、调整、约束、规范公务员活动的标准或准则，它是公务员的行为规范，而且是保证公务员按其职责履行公务，确保行政工作的正常有序进行的制度。

在《中华人民共和国公务员法》中规定了十六项公务员“不得为”的行为，这些行为就是要求我国公务员必须遵守的纪律的基本内容。我们把这十六项“不得为”的行为具体归纳起来，可以分为如下五个方面[ 参见《中华人民共和国公务员法》第53条]。

1.1 政治纪律

公务员除了是国家工作人员的代表，而且还是国家法律的忠实捍卫者和执行者[[]]。所以，公务员必须履行维护国家的根本利益和政治稳定的义务，而且这也是对公务员政治上的最基本要求，是由我国行政机关以及公务员的性质来决定的。……
