【摘要】旅游者合法权益保护问题是中国旅游发展中备受关注但始终未能妥善解决的问题。本文讨论了旅游者合法权益的基本内涵及内容范围；从旅游者、旅游经营者、政府三个方面阐述了保护旅游者合法权益的重要性；分析了中国的旅游者合法权益保护现状、存在问题及其根源。提出应当构建旅游者合法权益保护系统工程。该系统工程的内容主要由立法部分、执法部分、教育宣传部分构成。前两部分发挥基本运作功能，后一部分发挥外围保障功能。

【关键词】旅游者合法权益；保护；系统工程Abstract In Chinas tourism development, the protection of tourists legal rights is always paid great attention while still remained unsolved properly. In this thesis, the basic connotation and scope of tourists legal rights were discussed. The importance of protecting tourists legal rights was clarified from aspects of tourists, tourism operators and government. The present situation of Chinas protection of tourists legal rights, the existing problems and their roots were analyzed. Basing on these problems, it was proposed that a protective system for tourists legal rights should be built and that such a system is mainly made up of three parts: legislation, enforcing the law, education and promotion.

一、问题的提出旅游者合法权益保护问题似乎已经不再属于前沿问题了，然而却是一个始终未能有效解决的问题。各种新闻媒体接二连三地报道旅游者合法权益受损事件；消费者协会、政府旅游主管机构以至法院在有增无减地受理旅游者合法权益方面的投诉或诉讼；旅游理论界也从不同的角度研究和探讨旅游者合法權益保护方面的问题，并且不断有各种论文发表。遗憾的是，从理论研究到实业运作两个方面看，对于旅游者合法权益保护中一些最基本的问题，似乎未必有一个十分清醒的认识。
