摘要：在专利信息的发展交流中，专利翻译有着重要的作用，专利文献具有独特的词汇和语句特点，副词“there+介词”作为法律用词经常用于专利文献中，体现了其严谨性，本文主要探讨了专利文献汉译英中常见的几种副词“there+介词”的典型用法。

0引言

随着国家经济和科技水平的发展，专利申请量迅速增加，在专利技术的对外交流发展中，专利翻译的需求日益增长，准确严谨的专利文献翻译对于技术方案的描述和申请人权利的保护都有重要的意义。专利文献由于其严谨、准确语言特点，常使用一些法律用词，体现了其正式性及严谨性。能否正确使用这类词汇，对于专利文献翻译的专业性和准确性有重要影响。

由“there+介词”构成的副词，常见于法律文件中，理解时“there+介词”相当于“介词+代词”，常见的如“thereof”相当于“of it”，“therefor”相当于“for it”，其中代词如“it”指代句子前面已出现过的某个名词或名词词组^[1]。在英文专利文献中，代词，比如“it，them，they”等不应该用来表示发明的要素，因为这样的表达经常会引起混淆。通常只有在使用其他的词会影响句子的可读性的情况下才使用代词。因而，在英文专利申请中为避免使用代词，会通过重复所涉及的名词或者通过使用副词来保证表达的清晰，这类副词对于避免重复或者使用代词是很有用的。下面结合专利申请文件翻译的一些实例分析这类副词的典型用法。

1 thereof

原文：本发明提供了一类具有以下通式I表示的结构的化合物及其药学上可接受的盐，以及其在……的用途。

译文： The present invention provides the compounds having the structure represented by general formula I and their pharmaceutically acceptable salts， and their use…

修改：The present invention provides compounds having the structure represented by general formula I， pharmaceutically acceptable salts thereof， and a use thereof…

分析：在翻译专利文献时，要尽量清楚，避免语义的混淆，汉语代词“其”的含义应在英文翻译中保留，不能省略，但是要尽量避免使用物主代词their等，这些代词容易引起混淆，在翻译时使用thereof可以保证表达的清晰，pharmaceutically acceptable salts thereof要比their pharmaceutically acceptable salts更好。

2 therefor

原文：轉印膜及其制备方法和应用。

译文：Transfer membrane， preparation method thereof and application thereof.

修改：Transfer membrane， preparation method therefor and application thereof.

分析：专利文献翻译要求言简意赅，此例中为了避免重复和使用代词，译者使用了两个thereof，但是介词of和for在用法上是有差别的，需要仔细分辨。of是表达所属关系最常见的介词，在汉英翻译中，汉语中使用“的”字来连接名词时，常用of来表达所属关系，但由于汉语和英语的差异，汉语中“的”可以表示所属关系也可以表示非所属关系，翻译时如果都用of就会影响译文质量，不能准确表达原文的含义^[2]。最常见的就是of和for的混淆，for可表示对象、用途、目的、原因等，在翻译时需要分析“的”表达的是所属关系还是非所属关系，这个例子中是用于制备转印膜的方法，即the method exists for preparation of the membrane，不是所属关系，应该使用method therefor，而转印膜的应用，即the application is a use of the membrane是所属关系，应该使用application thereof。

3 Therebetween

原文：所述侧垫板与固定板内侧凹槽贴紧，其间隙不大于1mm。

译文：The side shim plate is closely attached to the groove in the inner side of the fixed plate， and the gap between the side shim plate and the groove is not more than 1 mm.

修改：The side shim plate is closely attached to the groove in the inner side of the fixed plate， and the gap therebetween is not more than 1 mm.

分析：侧垫板与固定板内侧凹槽之间的间隙，重复使用了the side shim plate and the groove，比较冗余，可以使用the gap therebetween来避免名词的重复，使句子更简洁。

4therein

原文：这种微球树脂其由微球树脂骨架及包裹于其中的磁性颗粒所构成。

译文：The microsphere resin consists of the framework of microsphere resin and magnetic granules embedded in it.

修改：The microsphere resin consists of the framework of microsphere resin and magnetic granules embedded therein.

分析：在专利文献的汉英翻译中，由于代词it指代不清楚，容易引起歧义，因此应避免使用it。原文含义是磁性颗粒包裹在微球树脂骨架中，翻译时为了避免句子以代词结束或者framework of microsphere resin的重复使用可以用副词therein来表达在微球树脂骨架中。

5Thereon

散热装置包括基板，基板上具有吸热端面，基板内部具有多条中空管路。

译文：The heat dissipation device comprises a substrate on which is a heat absorbing face， and inside of which are multiple hollow tubes.

修改：The heat dissipation device comprises a substrate having a heat absorbing face thereon and having multiple hollow tubes therein.

分析：英语中使用which引导的从句可以简化句子结构并且避免繁复的名词或名词词组的重复。但是在专利文献中，可能的情况下，最好是避免使用which，从而避免引起歧义。这里翻译时最好使用副词thereon和therein替代使用which引导从句。

6therebelow

原文：在12键式电话数字键盘下方具有辅助功能键而构成单手和弦小键盘。

译文：A single-hand chord keypad is composed of 12-key telephone number keypad below auxiliary function keys.

修改：A single-hand chord keypad is composed of a 12-key telephone number keypad having auxiliary function keys therebelow.

分析：原译文telephone number keypad below auxiliary function keys使用介词below，意思就变成电话数字键盘在辅助功能键下方，与原文的意思正好相反，正确的位置关系应该是auxiliary function keys below the 12-key telephone number keypad，为避免名词12-key telephone number keypad的重复应使用副词therebelow。

7thereto

原文：每个第一低反射网点位于与其对应的LED的正前方。

译文：Each first low-reflection dot is positioned directly in front of the corresponding LED thereof.

修改：Each first low-reflection dot is positioned directly in front of the LED corresponding thereto.

分析：“与其对应的LED”应译为the LED corresponding to it，it指代Each first low-reflection dot，因此使用thereto代替to it即可清楚表达与每个第一低反射网点对应的LED。

8 Thereby

原文：当前拥有热键的应用实例在退出时可以通知下一个应用实例去注册该热键，从而保证了热键的可传递性，实现了热键的共享。

译文：The application instance currently holding the hotkey can inform the next application instance to register the hotkey when the application instance exits， therefore， transferability of the hotkey is ensured， and sharing of the hotkey is implemented.

修改：The application instance currently holding the hotkey can inform the next application instance to register the hotkey when the application instance exits， thereby ensuring transferability of the hotkey， and enabling sharing of same.

分析：thereby和therefore两个词在翻译时经常备混用，英文中两个词的含义是有差别的，thereby相当于by it，指代前面分句内容是后面分句内容的条件，表示通过……方式、从而的意思，通常直接引导一个分词短语作为结果状语，表示由前面所述的动作引起一个结果^[3]。therefore相当于for it，指代的前面分句内容是后面分句内容的原因，表示由于……原因、因此的意思，一般连接句子，therefore是副词，连接两个分句时，其前面要加and。

综上所述，通过对专利文献中常出现的几种“there+介词”类副词的典型用法进行分析，从汉译英的角度总结了这类副词的使用技巧。由于专利文献的严谨性和逻辑性，这类副词对专利文献的可读性以及专业严谨的描述技术方案有着重要的影响，在专利文献的翻译过程中，结合技术方案的理解，灵活运用一定的翻译技巧，正确使用专利术语和专业术语，才能清楚准确的表达专利申请想要保护的技术方案内容，提升专利文献汉英翻译的质量，更好的保护发明人的權益。
